I’m surprised you let him go for a 35 yo tbh Its the team's decision to honour a player's NTC/NMC (both IRL and here) An IRL example is PK Subban, when the Canadiens signed him to his current contract, it included an NMC. He was traded to NSH before the NMC came into effect, and Nashville did not honour his NMC, hence when NSH traded him to NJ they didn't have to ask him to waive to go there. Players can refuse to waive if their NMC won't be honoured (which kinda sucks for Subban, cause he had no choice) In this league I did that with Giroux in Dallas.
